Under this new law, all residential property sellers are required to provide a Form 2 Seller Disclosure Statement and copies of searches/certificates to the buyer before any contract can be signed.
What does this mean for you as a buyer?
Before proceeding with a contract, you will receive a Seller Disclosure Report that outlines essential details about the property, including:
- Title and survey plan;
- Zoning information;
- Encumbrances and details of any relevant agreements;
- Pool safety notices; as well as
- Financial information like rates and water access charges.
This report is designed to provide you with full transparency so that you can make an informed purchasing decision with confidence.
It doesn’t replace building and pest inspections, but it gives you confidence before you commit.
Now, if you’re the one selling property or land, this new law means you need to have certain legal paperwork ready before your property goes on the market. It’s all about giving buyers clear, accurate information upfront so there are no surprises later.
Before a buyer can sign a contract, you’ll need to:
